Terms of Service

These Terms of Service ("Terms") govern your access to and use of ESP Champ (the "Service"), an extra-sensory perception testing game available at espchamp.com. The Service is operated by Vision Tech LLC ("Company," "we," "us," or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Acceptance of Terms

By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference. We may modify these Terms at any time; changes become effective when posted. Your continued use after changes are posted constitutes acceptance of the revised Terms.

2. The Service

ESP Champ is an online game and self-experimentation tool in the tradition of Zener-card testing. You attempt to sense which hidden symbol card has been selected, and the Service scores your guesses against statistical chance, shows significance measures (such as a p-value), and tracks your results over time. The Service also supports group "events" in which a host runs a shared test and participants compare results. The Service is provided for entertainment and educational purposes (see Section 6).

3. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction, whichever is greater) to create an account or use the Service. By using the Service, you represent and warrant that you meet this requirement and that the information you provide is accurate.

4. Your Account

• You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
• You agree to provide accurate registration information and to keep it current.
• You agree to notify us promptly at support@espchamp.com of any unauthorized use of your account.
• We offer email verification and, where available, two-factor authentication to help protect your account; you are encouraged to use them.
• You may delete your data and anonymize your account at any time, as described in our Privacy Policy.

5. Acceptable Use

You agree to use the Service only for lawful purposes and not to:

• Use any bot, script, scraper, or automated means to play, access, or manipulate the Service, scores, or leaderboards.
• Attempt to gain unauthorized access to the Service, other accounts, or our systems or networks, or probe or test their security without our written permission.
• Interfere with or disrupt the Service, or transmit any virus, malware, or harmful code.
• Impersonate any person or entity, or misrepresent your affiliation.
• Harvest or collect information about other users, or post unlawful, infringing, harassing, or objectionable content.
• Reverse engineer or attempt to extract source code except to the extent permitted by applicable law.

We may suspend or terminate access for conduct we believe violates these Terms or harms the Service, other users, or the public.

6. Entertainment Purpose & No Guarantees

ESP Champ is provided for entertainment, curiosity, and personal experimentation. Extra-sensory perception is not an established scientific fact, and the Service makes no claim that ESP is real or that you possess any psychic or paranormal ability. Scores, hit rates, p-values, and trends are statistical measurements of your guesses against random chance — they describe your results, they do not prove extra-sensory perception, and a strong result is often ordinary random variation. The Service is not medical, psychological, financial, or professional advice, and must not be relied upon for any decision. We do not guarantee any particular result, accuracy of interpretation, or outcome from using the Service.

7. Event Content

If you host an event, you are responsible for the text and statements you enter, and you represent that you have the right to use them and that they are lawful and not infringing or objectionable. You grant us a limited license to store and display that content within the Service as needed to operate your event. We may remove content that violates these Terms.

8. Intellectual Property

The Service and all of its content — software, text, graphics, card art, logos, and design — are owned by Vision Tech LLC or its licensors and are protected by United States and international intellectual-property laws. The "ESP Champ" name and logo are trademarks of Vision Tech LLC. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose. You may not copy, modify, distribute, sell, or create derivative works from the Service except as expressly permitted.

9. Email & SMS Communications

By creating an account, you agree to receive transactional messages necessary to provide the Service (such as email verification, password resets, and security and activity notices). Optional promotional email and any text messaging or two-factor authentication are governed by your consent and the choices described in our Privacy Policy (Sections 5 and 6), including opt-out and STOP/HELP keywords for SMS.

10. Suspension & Termination

You may stop using the Service at any time and may delete your data as described in the Privacy Policy. We may suspend, disable, or terminate your account, with or without notice, for violation of these Terms, suspected fraud or abuse, or as required by law. Sections intended to survive termination (including Sections 6, 8, 11–14, and 17) will continue to apply.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, VISION TECH LLC DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any result or interpretation it provides is accurate or reliable.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL VISION TECH LLC, ITS OFFICERS, MEMBERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, STATUTE, OR ANY OTHER THEORY, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100.00).

13. Indemnification

You agree to indemnify, defend, and hold harmless Vision Tech LLC and its officers, members, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any law; or (d) your infringement of the rights of any third party.

14. Governing Law & Disputes

These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-law provisions. Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Maricopa County, Arizona, and you consent to their personal jurisdiction and venue. The parties agree to attempt to resolve any dispute informally before initiating formal proceedings.

15. Changes to These Terms

We may revise these Terms from time to time. When we make material changes, we will update the "Last Updated" date above. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

16. Severability

If any provision of these Terms is held invalid or unenforceable, that provision will be modified to the minimum extent necessary or severed, and the remaining provisions will continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Vision Tech LLC regarding the Service and supersede all prior understandings relating to it.
